Morpheus® Forum™ Privacy Policy

NOTE: Neither this Privacy Policy or any Terms of Use for Morpheus Forum apply to your use of the Morpheus® Peer-to-Peer software application for P2P file searching or sharing, or any other use, product or services, unless otherwise specified, and do not in whole or in part constitute an End User License Agreement for use of the Morpheus software application including for P2P or web search or anything other than Morpheus Forum. You do not need to download or use the Morpheus software application to participate in Morpheus Forum. The Morpheus software application does not collect personally identifiable information and, therefore, the personally identifiable information your supply to Morpheus Forum can not be used by Morpheus Forum to monitor your use of the Morpheus software application.

Morpheus Forum values your anonymity and privacy. Morpheus Forum encourages you to read the following privacy policy to ensure you understand Morpheus Forum's privacy practices. By visiting the Morpheus Forum website (www.morpheusforum.com), you are agreeing to the practices set forth in the privacy policy.

Applicability

The privacy policy applies only to the collection and use of personally identifiable information you provide to Morpheus Forum any time you interact with Morpheus Forum including when you visit the Morpheus Forum website, register and/or login. Personally identifiable information is defined as information that will allow an individual to identify you, including a first and last name, a home or other physical address, and an email address.

Neither this Privacy Policy or any Terms of Use apply to your use of the Morpheus software application for P2P file searching or sharing, or any other use, product or services, unless otherwise specified, and do not in whole or in part constitute an End User License Agreement for use of the Morpheus software application including for P2P or web search or anything other than Morpheus Forum.

The privacy policy does not apply to any personally identifiable information you provide to any other party including in a User Name, Signature, discussion forum post, email to another Morpheus Forum user, private messages (which are accessible only when you are logged into Morpheus Forum) to another Morpheus Forum user and transmission to other websites including those website you access via links from the Morpheus Forum website or via links available in a user's posting. Morpheus Forum encourages you to read the privacy policy of any website you visit and use caution when disclosing any information about yourself.

Registration

You do not need to register to visit the Morpheus Forum's website or read posts from the various Morpheus Forum discussion forums. However, you must register and login in order to post to the various Morpheus Forum discussion forums.

Upon registration, you will be asked to enter your birthday, valid email address and password (collectively referred to as "Account Information"). In addition the above information, you will be asked to select a User Name and enter a random code for image verification purposes. Your User Name will be displayed as the source of your post and, thus, will be made public. Morpheus Forum encourages you to select a User Name that does NOT include any personally identifiable information.

After you have submitted the above information, Morpheus Forum will send an automated response to the email address provided. You will need to confirm your intent to register by clicking on the link that is provided in that automated response. If you do not confirm your intent to register within 7 days of receiving the confirmation email your account will be terminated.

Please note that in addition to your User Name, Morpheus Forum will include with your post the date of your registration ("Registration Date") and the title of either Junior Member, Member or Senior Member ("Title"). In addition, you may select a signature to be included at the end of your post ("Signature"). Morpheus Forum encourages you to select a Signature that does not include any personally identifiable information.

Your Account Information, information provided by the use of the cookie (see below), and any other personally identifiable information you provide Morpheus Forum (collectively referred to as "Records") along with your User Name, Registration Date, Title and, if created, Signature and IP Address, will only used by Morpheus Forum for the purpose of hosting or running the Morpheus Forum, including participation in the Morpheus Forum discussion forums and responding to communication you initiate and for other administrative purposes. (See, however, the section called "Information Sharing," below.)

User Control Panel ("User CP" on the Forum page)

Please be aware that there are options available in the Control Panel section of the Morpheus Forum webpage. Some of the options are listed below:

1. You may decide whether you would like to receive emails and/or private messages from other Morpheus Forum Users and emails from Morpheus Forum. You will not be able to disable the feature that allows Morpheus Forum to communicate with you via private messages. The default is set so that you will not be able to receive communication from other Morpheus Forum users via email or private messages and you will not be able to receive communication from Morpheus Forum via email. You will, however, be able to receive private messages from Morpheus Forum.
2. You may change your password and email address.
3. You may identify those Morpheus Forum users you wish not to receive private messages from.
4. You may select Invisible Profile and, thus, browse the Morpheus Forum discussion forums without other Morpheus Forum users seeing you.

Children

Morpheus Forum does not knowingly collect personally identifiable information from children under the age of 13. If Morpheus Forum learns that a child under the age of 13 has registered with the Morpheus Forum website and/or submitted personally identifiable information to Morpheus Forum, we will immediately remove all the child's posts (including User Name, Registration Date, Title and, if created, Signature) from the Morpheus Forum discussion forums and delete and/or destroy the child's Records, User Name (including Registration Date, Title and, if created, Signature) and posts from Morpheus Forum's records. Morpheus Forum will not delete the child's IP Address; however, the IP Address will not include or be tied to any personally identifiable information. If a parent has learned that his/her child has registered with the Morpheus Forum website and/or submitted personally identifiable information the parent may request access to the child's Records, User Name (including Registration Date, Title and, if created, Signature) and posts by contacting Morpheus Forum using the attached form. If Morpheus Forum has not yet removed the child's posts and User Name (including Registration Date, Title and, if created, Signature) and/or deleted and/or destroyed the child's Records, User Name (including Registration Date, Title and, if created, Signature) and posts, Morpheus Forum will honor the parent's request upon receipt of proper identification and satisfactory evidence that the person is, indeed, the parent of the child and that the child is under the age of 13.

Cookies and Server Logs

Upon registering with Morpheus Forum website, Morpheus Forum will send your computer a cookie that will store your username and password. Cookies are used to enable functions such as showing whether or not a thread or forum you are viewing has new posts since your last visit, or to automatically log you back in when you return to the site after being away for a while. If you are using a shared computer, such as in a library, school or internet cafe, or if you have reason to not trust any other user that might use this computer, we recommend that you disable cookies. There are two ways to avoid the use of cookies. First, after you register, you may disable this feature by logging out and deselecting the "Remember Me" box when logging back in. Second, your web browser toolbar may have a setting that will allow you to prevent your browser from accepting a cookie.

In addition to cookies, server logs will record your IP Address. Morpheus Forum uses the information provided via cookies and your IP Address to customize your Morpheus Forum experience.

Morpheus Forum does not monitor, report or collect any other search, download or upload behavior.

Information Sharing

Morpheus Forum may disclose your Records to its parent company and any subsidiaries of its parent company. Morpheus Forum will not, without a user's informed and confirmed written consent, disclose your Records to any other parties, unless required to by law or if Morpheus Forum believes, in a good faith, that such disclosure is reasonably necessary to comply with the law, protect Morpheus Forum and its affiliates, enforce the Terms of Use, respond to claims that any post violates the rights of Morpheus Forum users or other third-parties.

Changes to Account Information/Removing Account Information from Morpheus Forum Website

If you are a registered user and would like to make change your email account and/or password please see the personal settings section of the Morpheus Forum website.

If you are a registered user and would like to change your User Name, please feel free to request that your account information be removed from the Morpheus Forum Website in the Morpheus Forum Help/Feedback Forum, however, do not post personal information. If your account information is removed from the Morpheus Forum Website, you must then re-register with a new User Name. Please note that once your account information is removed you will not be able to request use of any of your past User Names

If you are a registered user and would like to remove your account information from the Morpheus Forum Website, please feel free to request that your account information be removed from the Morpheus Forum Website in the Morpheus Forum Help/Feedback Forum, however, do not post personal information.

Within a reasonable period of time after requesting removal of your account information from the Morpheus Forum Website, Morpheus Forum may remove all your posts (including your User Name, Registration Date and any Titles and/or Signatures) from the Morpheus Forum website.

Please note that Morpheus Forum may retain a list of past and current User Names, Account Information, Records, IP Addresses and posts.

Security

Except as otherwise set out herein, only employees who need your Records for the purpose of running Morpheus Forum or other administrative purpose will have access.

Changes to this Policy

Morpheus Forum reserves the right to update this policy from time to time, with or without notice. It is your responsibility to monitor this Policy to determine if it has been updated. You can access the new privacy policy via the privacy policy link on the Morpheus Forum homepage or via the privacy policy link in the Morpheus Forum terms of use.
